California Governor Gavin Newsom has taken Donald Trump’s playbook and flipped it on its head to sue Fox News for defamation. Newsom’s lawsuit against the network – seeking $787 MILLION – alleges that the network intentionally lied about Newsom receiving a phone call from Trump during the LA protests in order to spread misinformation for the benefit of the administration. Donald Trump loves to sue everybody. And ever since he won the presidential election back in November, he has actually used the threat of lawsuits and of course actual lawsuits against media outlets against, you know, law firms, corporations, whatever it is. He has used these lawsuits to get everything that he has wanted. And unfortunately, the people that he's been suing have played right into it. They have bowed down, they have kissed the ring. They have given Donald Trump everything he wanted, even though every single one of these lawsuits was easily winnable by the party that Trump was suing. They just didn't wanna do it. They didn't wanna fight it. They didn't want to be on his bad side. So they gave in to him. I said from the beginning that Democrats need to do this too, because if Donald Trump can sue media outlets for saying things he doesn't like, even if they're true, you know, basically file fake defamation lawsuits, then Democrats can very easily file real defamation lawsuits against Fox News, newsmax one America, any conservative commentator out there.

So do it. Well, late last week, somebody did do it, and that somebody is none other than California Governor Gavin Newsom, who filed a $787 million defamation lawsuit against Fox News. This lawsuit is based on something that Jesse Waters said on his recent program. Here's what happened. As we all know, during the LA protest, Donald Trump came out. He was asked by a reporter, when was the last time you talked to Gavin Newsom about it? And Trump, of course, went out there and he said, well, we had a talk yesterday. And he was very mean, he was rude, blah, blah, blah. And Newsom came out and said, that call never happened. I have not spoken to Donald Trump in weeks. We did not just talk the other day. So in response to Newsom saying, we never had a phone call, Jesse Waters went on Fox News at the time and said, Gavin Newsom is lying. Donald Trump absolutely did call, and Gavin Newsom is, you know, doing whatever in California. Trump's trying to fix it. But by saying, Newsom lied when he didn't. According to Newsom, that is grounds for defamation. Hell, Donald Trump has lost two defamation lawsuits simply by calling somebody a liar, Eugene Carroll. So we know that's winnable. We know that's an actionable claim.

And Gavin Newsome Newsom said, I'm gonna do it. I'm gonna be the one to set the standard. I'm gonna set the precedent. Now, I don't love every single thing Gavin Newsom has done. I don't live in California. So you know, I, I don't know the intricacies and ins and out of every policy

He's done. I know some progressives are not happy, some are happy. But that's kind of how it is with any politician. But I, what I will tell you with this is that this move is one of the smartest things I have seen a Democrat do in years. In his lawsuit, Newsom is alleging that Fox News lied and defamed him, but not just to defame him. They lied to benefit a third party, which is actionable by the way, that third party was Donald Trump and this Trump administration. So Newsom may not have suffered any technical damages, which of course is paramount to a defamation lawsuit. But in lieu of him suffering damages, if you can prove somebody defamed you in order to benefit your party or another party that you're connected to, you have an action. And that is what Newsom did. It's brilliant.
