Ukrainian President Volodymyr Zelenskiy and Council of Europe Secretary General Alain Berset on Wednesday (June 25) signed a bilateral agreement laying the foundation for a special tribunal to prosecute senior Russian officials for the crime of aggression against Ukraine.
Speaking from Strasbourg, Berset said the accord marks a "decisive step" toward establishing a dedicated tribunal outside the International Criminal Court (ICC), which has jurisdictional limits when it comes to prosecuting aggression involving non-member states like Russia.
"Together with President Zelenskiy we have signed a bilateral agreement between Ukraine and the Council of Europe. Today’s signature is a decisive step towards establishing a special tribunal for the crime of aggression against Ukraine," Berset said.
Zelenskiy said the effort aims to ensure accountability for all levels of leadership behind Russia’s war on Ukraine:
"Every war criminal must know there will be justice, and that includes Russia. And we are now boosting the legal work in a serious way. There is still a long way to go."
The 46-member Council of Europe approved the creation of the tribunal in May, positioning it as a legal complement to the ICC, which has already issued an arrest warrant for Russian President Vladimir Putin over the deportation of Ukrainian children.
The special tribunal would focus specifically on prosecuting top-level decisions behind Russia’s invasion, helping fill a gap in international law regarding the crime of aggression.
