The Register revealed that a reporter in Germany asked Microsoft Copilot to build his bio. His beat included covering the local courts. The AI decided that this reporter not only reported on certain crimes, but that he committed them. The reporter also asked Copilot to develop a bio for a judge – it did the same thing.
At a seminar late last year, I noticed that Wendy Nather, at Cisco, formerly with Duo, had built her profile for the conference using ChatGPT. It decided that her resume should include five years of service with the NSA – but Wendy never worked there. ChatGPT decided that the sentence about NSA was statistically likely in documents of that sort, so it put it there.
Something like this happened to me years ago. I was confused with a person on a terrorist watch list and was not allowed to take a flight from LGA to Orlando. An algorithm had decided that I was someone else, and in a Kafkaesque moment I was a non-person. Fortunately, I was then working with a Special Agent at the NY Secret Service office, and with one phone call that was corrected.
ChatGPT and LLM-based AI tools rate the word “committed” higher than the word “observed.” If you actually observed a crime, the LLM will perfect the sentence by stating that you committed a crime.
This does not require new laws governing AI. Anyone can sue for libel – publishing a falsehood that causes damage. When a major search engine like Google publishes that someone has committed a crime, that seems like libel to me. I would appreciate hearing from any attorney who might have more insight into the relevant laws.
What can you do? It’s always a good idea to search your name using your favorite search engine and check out what it thinks of you. If you are in an area governed by the GDPR, you can demand that incorrect information be removed. You can ask the credit reporting agencies to block access to your financial history, to prevent inappropriate access by scammers and market research firms. This is especially important if your SSN has been compromised, as most of us were, by the breach of a few weeks ago. And ask an AI tool to write your bio – you may just get a surprise.
