All of us can probably agree that it's nearly impossible to avoid encountering tomatoes in some form or fashion at nearly every restaurant, from the fanciest food joints on the planet, to the grimiest fast food spots you've ever seen.
But there's one aspect of our favorite juicy red blobs about which you might find yourself butting heads with others - what exactly ARE tomatoes? Are they a fruit or a vegetable?
It turns out that it depends on who you ask and the context. But it wasn't always this way. Nearly 130 years ago, a man named John Nix sued a New York tariff collector in a case that would ultimately make its way all the way up to the Supreme Court. And we've been living with the consequences of that decision ever since.

This is the story of how and why tomatoes, a botanical fruit, legally became vegetables.
