In Australia Swimming Pool & Spa fencing regulations any gap that is 13mm or less is considered 'not a gap' so by placing these pailings at 12mm apart even though there is a stay on the back of this gate it is compliant. I have placed the hinges 900mm apart top to top, so they are also compliant. The back rails on the fence are also 900mm apart so those palings could be unto 100mm apart. The gate also needs to be self closing and self latching.
